New Indiana Laws 2020


The Indiana Governor signed 167 new bills into law this year. Below is a list of some of the most noteable laws taking effect July 1, 2020 or in 2021.

HEA 1235 
911 Fee - The Statewide 911 Board is authorized to increase the fee paid by all telephone users for access to 911 emergency from $1 per month to $1.10 per month.

Coverage for Breast Prostheses - Indiana state employee health plans which provide coverage for a mastectomy must also provide coverage for custom fabricated breast prostheses, including one additional breast prosthesis per breast affected by the mastectomy.

​Cancer Screening - In most situations, health insurance companies are obligated to cover colorectal cancer screening starting at age 45, instead of 50. This is in accordance with a recent recommendation from the American Cancer Society.

Child Sex Crimes - Justice for victims of sexual assault.
In an effort to improve justice for victims of sexual assault, an extension has been created regarding the statute of limitations for sex crimes against children. This allows victims to seek justice, if new evidence comes to light years later by extending the statute by 5 years. The deadline for victims to seek assistance from the Violent Crimes Victim Compensation Fund also is extended.

SEA 197
Prohibited Technology Purchases - All state agencies and departments in Indiana, including universities and local government units, are prohibited from using public funds to purchase products or services from Huawei Technologies or ZTE Corporation.

Distracted Driving - Hands Free
Makes it illegal for drivers to hold or use a handheld mobile device while operating a moving vehicle. Motorists will be required to use hands-free or voice-operated technology if using a cellphone behind the wheel. Contacting 911 in the case of an emergency is an exception to the new rule.

HEA 1065
Various Tax Matters Bill - Allows charter schools to be included and receive money that is passed via referendum to fund local schools. Does not allow virtual charters to be included and it must be stated in the resolution that the funding may go to a charter school.

SEA 005
Health Pricing - Hospitals, outpatient surgery centers, and urgent care clinics are required to post  on their websites the most frequently used services and what they cost by March 31, 2021. The Indiana Department of Insurance is to begin the process of creating an all-payer claims database to improve transparency in health care costs.

Healthcare Coverage for Hoosier Farmers - Gives a non-profit agricultural organization the authority to provide health care benefit coverage that is sponsored by the nonprofit agricultural organization, offered only to members and their families, deemed important to assisting its members, and offered in every county in Indiana.

Insulin - Repeals the need to have a prescription to purchase insulin in Indiana beginning January 1, 2021

Good - Faith Estimate - Most healthcare providers must give a good-faith estimate when requested by a patient. The requirement takes effect July 1, 2021.

Telemedicine for Eye Exams - Hoosiers from ages 18 - 55 may get a prescription for glasses or contacts by using telemedicine, as long as they have had an in-person eye exam and/or contact lens fitting in the previous two years. Hoosiers can only do two online eye exams in a two year period.

Smoking and Vaping - The smoking and vaping age for tobacco products has been raised to 21. Indiana retailers who sell tobacco products to underage purchases face double the fines anywhere between $400 - $2,000. New tobacco retailers cannot be located within 1,000 feet of a school.

Teacher Evaluations - The state mandate that required annual teacher evaluations and, therefore, pay increases be largely determined by State Test results is eliminated.
